Everyone expects to have a bad day every now and then. But a REALLY bad day can blindside a guy when he least expects it. I am so angry I can hardly speak let alone type, so my lovely assistant is posting this note to the forum for me.
Imagine my surprise when I received the following e-mail this morning. I thought it was a compliment about my new website. It’s not. It’s a snotty note regarding Intellectual Property and copyrights. Please read on:
1992-2003 Copyright World Class Steels Inc.
David:
Very nice site you have now. So nice that we can tell you have the knowledge
or your web designer has the knowledge to get this corrected for now and the
future.
What we are about to say is NO different than if we were to take YOUR
intellectual property (your CD) up on our Site withOUT even crediting you or
mentioning your name and then allow people to download it for free.
We AGAIN (this is probably the 3rd or 4th time we've gone through this with
you with your various hosting companies) ask that you CREDIT us directly
below the photo on this page: http://www.davidwright.us/mem_sac.htm
specifically this photo: http://www.davidwright.us/images/photos/sac3.jpg
OR REMOVE the photo.
The photo in question was:
1.taken with our camera;
2.by US
3.processed by us
4.put on our web site with COPYRIGHT notices ***
Guess whom this is from? That’s right, Fabian, President of Carter Steel Guitars.
My deepest sympathy goes out to the Carter Company for being so petty as to make an issue out of a photograph. They want me to credit them with taking of a photo. Ok…..I didn’t know getting credit for taking a picture was such a big deal. I did not in any way mean to STEAL from them. I was merely using a photograph of ME on MY website. I thought that if they were using my picture I could too. Such is not the case. They have slapped my hand for the last time. Because they forgot about item number 5.
They are using my image illegally. I have been informed that they can’t use my image without my written permission. Carter Guitars never asked me to sign a photo release. They have 48 hours to remove all photographs of me or I will sue them for using my image to endorse their website without my permission.
Uggghh!! Doesn’t that sound awful? But it’s true. I have that right. I hate to air my dirty laundry in public but the point I’m trying to make here is that with a little decency and tact (who would’ve ever thought I’d be lecturing about tact!) this would’ve never been an issue. Grant it my ignorance of copyright laws is no excuse. I should’ve never let Carter Guitars think that we have a “professional” relationship. I know them well and should’ve never given them an inch, because now they are taking a mile!! When I first saw a photograph of me on their website (regardless of who the photographer was or what camera was used) I should’ve said “Hell No! You aren’t using my picture to beautify your page!” And this would’ve never been an issue. I just thought we were all one big, happy Steel Guitar family. Helping one another when we can, where we can, by being gracious and not stirring up a ruckus over a silly thing like a picture. Who would’ve ever thought that a fellow member of this community would be so quick to jump to the conclusion that someone was stealing from them? And look at what was being stolen. A picture of a bald headed guy doing what he loves! Does that make any sense to you??????? It never even crossed my mind that someone would be this trivial…. this suspicious…. this mean spirited.
So please accept my apologies. I shouldn’t have ever been the nice guy and let them use my picture in the first place. Because 1) I knew better than to be nice to them. 2) I knew it would end up getting ugly between us one day. 3) As Fabian has pointed out, nice guys finish up being threatened and harassed and forced to get ugly and turn the law against their accuser. 4) Now we know why there are so many lawyers in this world.
Thanks for listening!

Interesting, but I'd better not comment and just put a lock on this one.

Upon reflection, I realize I was heavy-handed in how I handled the initial copyright email with David Wright. We are in the process of reviewing our policies at this time and making appropriate changes.
I spoke with David Wright for about 20 minutes today about this, apologized to him for any upset or problems this may have caused him, and made this right with him.
And, as David said, life's too short to sweat the small things.
I am not perfect so if you have a problem with something I or this Company have said or done, please pick up the phone and give us a call and we'll discuss it. I promise you that I will concentrate on using my mind for making my way through the world rather than mending it.

David Wright asked me to post this, and then lock it for good.
quote: "John and I have mended our fences. I'm very happy to have this resolved between us. Not only was his call was the stand-up thing to do it took courage to pick up the phone and discuss it like an adult.
As a result, I will be crediting Carter Steel Guitars for their picture on my site. I'd like to think I'm big enough to admit when I've made a mistake too. This is a tight knit community and we should all strive to be open and honest in our dealings with one another. Therefore, I've made a promise to John to shake his hand when next we meet; knowing that friendship will be extended and accepted by both of us." - David Wright
