Hi all, maybe a dumb question, but, when recording with background tracks, with a pedal steel on top, and uploading just the music to the internet. Not for sale, but just to listen to. Is it OK, or is it an infringement ? Is it any different that a UTube video of someone playing a tune, and posting it ?

Technically, both are infringment - unless you have the writer's or publisher's okay, or you have paid licensing fees for use of the song. Truth be told, probably 95% of the music on YouTube is in clear violation of copyright laws. The law makes no distinction as to whether or not you making money, it governs the performance and/or distribution of the song in any manner. |

Which is exacatly why I will not upload any thing that I have not written..I have one song on the web,and it's mine.I don't have much of monetary value,but I sure as hell don't intend to lose what little I do have..Just not takin chances..PJ... |

Thanks guys for the input. I kind of figured that was the case. I see so many videos and song postings of folks doing a song, that 9 times out of 10, is probably not licensed to do, but it gets posted anyway. I wanted to post a song, with my steel playing on top. The song actually won a grammy, so I figured that was the reason I could not up load it. It was too recognizable. Guess I'll have to write and record an original. I really liked the song too. Thanks again for your input.

Discovering this sort of copyright infringement is the responsibility of the copyright owner. It's a civil matter - he can take you to court and would most likely prevail. There's a statute of limitations, though. If the infringement isn't discovered with 3 years, the case would probably be thrown out of court.
In the case of YouTube infringements, most copyright owners figure it isn't worth their time, energy and expense to go after the little guys. If someone really does a great job on a song and is very proud of it, PAY THE ROYALTY and post it ! It's not hundreds of dollars it's maybe $25 or $30 for a single song. Many have us have multiple thousands invested in gear, another $30 ain't gonna send us the poor house, if it is really great, TAB it , put it on a CD and sell it !
If someone has an original song, good grief, send in the $30 and have it copyrighted, then post it ! IF it's a great song maybe you will get lucky and some producer or artist will hear it and contact you to use it !
We do know that there are websites such as garageband .com which is loaded with artists and original songs, where many are getting recording and even better, publishing deals. Producers and artist are LOOKING for songs, TAXI.com is always LOOKING for songs !

Sometime ago, there was a post that listed a place to send money and get the rights to record a song and distribute it. I can't find the thread. Can someone re-post this info? This may help with this problem. |

As an alternative to paying through an agent like Harry Fox, you can pay statutory royalty fees in accordance with the copyright laws. You can find info about this on the U.S. Copyright office website.
