Steelers,

Please give me some tips about how to pursue an ebay/paypal dispute. I've read the ebay and paypal directions, but I'll bet some of you out there know some important things that don't appear in those directions.

The seller answered my first two emails, but he hasn't responded to my subsequent emails for six days.

BTW the BIN price I paid is about the market rate listed in the Vintage Guitar Price Guide, so the seller didn't inflate or deflate the price unrealistically. Still, I wonder if somebody might have offered him more than the BIN I paid, and now the seller will just refund my money. But maybe it's worse than that.

You are in for a big pain in the you know what. Filing a claim with Paypal was one of the most frustrating things I have ever done. Mine was over a misrep item. Yours may be easier since you paid for an item and did not receive it. That is cut and dried. Mine did work out in my favor, but it took time and I had to jump through many hoops.

That's what I'm afraid of--that and a pain in the checking account.

Also, it's hard to find that model of guitar. It's a plain version of the more plentiful fancy version, which costs twice as much.

I have filed 2 previous claims with Paypal and have recieved all my monies back for defective merchandise. I have one pending now on a Black Widow speaker 1203-8 that arrived crushed and non working.
It took 120 days.

Dave,

I suspect that paypal makes a lot of money by (in effect) getting an interest free loan for 120 days from a lot of customers.

I think that you're right in that the seller may have recieved a better offer. $2K is a screamin' deal for that guitar. I sold a model 1000 pickup, like the one on the Guild, last month for $550.
I too have filed claims with PayPal and it took a while but they came through with the funds.

If you haven't received the item, and you haven't opened a Paypal dispute, go to Paypal and simply cancel the transaction. End of story.

I'd give him a chance since he has a 100% feedback rating. Something may have happened on his end......'stuff' happens.

I tend to agree with Mark. I've had sellers that were slow due to illness, or unforseen problems, who were very honest and appologetic for the delay.

After 10 days, though, I'd be pursuing a more serious remedy.

No!!! You only have so many days (45 I think but read the fine print) to file a dispute with PayPal. Go ahead and do it - item not received. Then you only have 20 (again, read the fine print to be sure of the numbers) days escalate it to a claim a few minutes later.

The sell will have a chance to respond. If he doesn't, you're payment will be refunded - but it may take some time.

The seller is responsible for proof of shipment. If that proof is not provided, you'll get the refund. For $2k, I wouldn't wait around. You're running out of time if you haven't already filed both parts.

Either way, go ahead and start the claim. You can always close it later if there actually is a problem. But if you wait too long, you're out of luck.

Judging from the seller's feedback and how long he's been a seller, there's probably not a problem. But it doesn't hurt to be safe.

Darryl, you can contact paypal and tell them the circumstances. They will then contact the seller and advise him to respond within 10 days. If seller does not respond within that time then paypal will debit his account and refund you for the amount you paid. You can also contact ebay and request the seller's phone number. Sometimes a simple call will do the trick. Good luck...

As suggested, try to get his contact info, try to call him,and by all means file a complaint with eBay and Paypal NOW, if you wait too long you're out of luck.
FWIW I always use a credit card to pay for higher priced purchases even with Paypal, that way you have some recourse through your credit card company too.
Short of a major illness or a computer crash there really is no good reason for the seller not to have contacted you.
Hope it all works out ok, stay on top of it though.

Right there is the reason I don't like E-bay or Pay Pal, too many problems, I have found that a Bank Money Order works a lot better for me.

I've done over 1500 transactions on Ebay and probably 75% of those used Paypal for payment. I have had only two transactions that I had to file disputes for. I've had three or four, non-paying bidders, but I just left negative feedback and re-listed the items, and Ebay refunds the final fee in these cases. I have had a lot more trouble than that with bank checking accounts.

If a seller has low feedback, or excessive negative feedback, I won't deal with them, no matter how good the deal looks. I usually ask some sort of question while the auction is running, just to see how well the seller communicates. If they do not respond or are slow to respond, I don't deal with them.

Sure there are bad apples in the Ebay family, but with over 16 million users, what do you expect.

I believed in Ebay enough when I first joined about 7 or 8 years ago, that I bought some of their stock. It has treated me really well.

Alan might have the solution. I hope it works that way. But it might be that you can't cancel a payment that easily, or else buyers would do it after they got the goods, right?

As Mark and Mike say, I shouldn't be too quick to think ill of the seller. I myself have forgotten to pay twice, and it's embarrassing, but the sellers were understanding.

On the other hand, as Gary says, I shouldn't be too slow, either. One of the good things about ebay is that their time frames are long enough to file a complaint--if you don't dawdle. But the long time it takes to get your money back makes me think that paypal makes money by dragging these things out.

Mike, is there a way to use a credit card even though the seller isn't set up for it?

Ernie, how can you get refunded with a money order or cashier's check? If the guy cashes it, you're out of luck, right?

However this turns out, ebay is a great resource. I've found so many different things that I just couldn't find otherwise. And it's good just for getting information.

However, there are some things I'd be reluctant to buy on ebay, and steels would be one of them. I did do it once because the seller was experienced and highly regarded (Hank Sable). But if a seller knows as little about steels as I do, he can make an honest mistake.

It may be that big ticket items are riskier. But if I have one bad deal out of my 300, that's a better rate than I get with local deals.

Not sure if I'm the Mike you're referring to, but....

Darryl, you can set up your account to use a credit card. Then, if you're using Paypal to make a purchase, the seller will not even know you've used a credit card to pay him. That's what I do. I also have a Paypal Debit Card, so if I have any money in the account, I can use it like cash for gas, groceries, etc., if I need to.

What do you do when you send a guy a money order for $2000 and you don't receive the merchandise?

Paying with PayPal is like using a credit card. You're protected if you do it right.
