BEWARE!

It happens all the time but........

[name deleted] or something similar has been profiting off of plagerized JERRY BYRD instructional manuals that he keeps pedaling over EBay.

No idea how long it's been going on or how much money he has ripped off from the legitimate source. No idea how many 'collectors' have been ripped by this dastardly immoral character.

The guy should be stopped. The FORUM could do it.

I've written to ebay along with at least two others.

HOW ABOUT YOU? Let's chase this guy off the internet for his thievery. 4-6,000 complaints to eBay should do it.

UPDATE from b0b: It appears that this EBay seller acquired these courses through a bulk purchase of musical items from a storage locker. We have traced the source back to the original purchaser of ONE copy of the course, who allegedly made these knock-offs.

The EBay seller was apparently unaware of the criminal origin of these items. They were part of a larger block of items that he actually wanted. He has agreed to stop selling them and is cooperating with the ongoing investigation.

I contacted Scotty about this several weeks ago, and he was surprised and upset about this. As you know, Scotty's Music is the only authorized outlet for the Jerry Byrd Big Course. I also sent an email to eBay explaining the situation, and they told me that they could not verify that copies were being sold, so they could take no action against the seller.

The JB Course is unbound, which makes it easy to copy, unfortunately. A couple hundred pages in a large 3-ring binder, and it sells for $107. So rip-off artists can easily copy it, put it in a binder and sell it for $80. One of those sellers on eBay has sold 17 JB courses recently according to his feedback ---> Click
He is also selling copies of the JB Video Course, which is a Scotty's product.

About the copyright stuff..........

There are ways around having a legitimate copyright filed and it doesn't always involve filing documents with the Federal Government or where ever.

The pages of more than one set purchased from this questionable perp........clearly shows that the punched holes of the original volume.....are there and clearly viewable in the photo copy version. Also, one such pirated volume, photo copies a sales ID number that Scotty now has.

Regardless of what limp wristed tactics eBay uses to avoid a conflict.......somewhat like Russia's denial that they are "in Georgia".........or that "they are pulling out at this very moment".....it doesn't make it fact.

4,000+ complaints to eBay by users of that service could easily have a much larger influcence on their conduct/response that one or two informative comments.

Come on guys/gals! A three minute complaint to eBay could do wonders for all of us and make them far more concerned about their own 'truth in selling' practices.

Many thanks for your assist! Now if the other 4,000+ Forumites will likewise participate in this public service endeavor, perhaps we can put the power back in the hands of the people. RIGHT?

Scotty & the family recipients should be entitled to receive whatever is rightfully theirs and not some low-life character that figured he could make a quick buck now that the author was deceased.

If you see any more of these bogus JB eBay auctions, scroll to the bottom of the auction page and click on the following:

Report this Item / Counterfeits and copyright violations / Bootlegs and counterfeit media / unauthorized photocopies of printed material

I don't know if this guy has any current auctions running, but you can file a report from one of his prior auctions listed on his feedback page ---> Click

If enough reports are filed, eBay will kick this guy off the site.

I seriously doubt your reporting it to ebay will do anything. You will have to PROVE you are the copyright holder, or authorized entity in order to have the auctions ended.

Your best course of action would be to contact the copyright holder, or authorized entity, because they are the ONLY ones who can VERO this and they will have to show PROOF.

Sorry to say, but 4000 angry reports to ebay will not get this guy booted. It used to do the trick, amongst other things, but not anymore.

Well, thanks to good ole' Sonny Bono, the copyright should have transferred to the estate, or some family member, unless of course it expired and was never renewed - in which case it would be public domain.

However, unless you are the absolute copyright holder, or the one authorized on the copyright holder's behalf, then it is unlikely ebay will end the auction.

You must either, become a VERO member, which means you are stating you own the copyright, or are authorized to act on the copyright holders behalf, or have the copyright holder file a vero. Ebay will ask for proof. They have had too many false veros, so as of today the policy is as such. It may change again tomorrow, as the policies have a record of doing.

Yes, I think it would be up to the copyright owner to contact eBay with proof of copyright ownership. I'm no expert in copyright, but it seems to me that a strongly worded letter from a lawyer would do the trick.

I am not sure what the Big Course is Doug. Is it a guitar course?

If a letter is sent from a lawyer who represents the copyright holder, then that would do the trick. If it is just any old lawyer, that will not do the trick, as Ebay will still want proof of ownership. And if the lawyer actually represented the entity, he would send proof anyway with his request, or even better, send documentation directly to the offender in the form of a registered letter stating to cease and decist or face a court injunction and damages.

But again, Copyright is not like speeding and getting pulled over by the cops. The copyright holder is the only one who can enforce the copyright. If the copyright holder chooses not to enforce the copyright, or If there is uncertainty as to who the copyright holder really is, and there is no active representation, then it is unlikely to come to the result this thread is seeking.

The Big course is Jerry Byrd's lap steel course, covering several tunings. It's about 300 pages with two CDs. The cost is $107. Scotty's Music is the sole distributor of this course. ---> Click

I don't mean to sound like an idiot, but what makes scottys the only one, or the "sole" distributor of the course? Does scottys own the copyrights to the original works? Or Do they have a license from Jerry Bird foundation?

The reason I am asking is - did they create all of Jerry Birds material, or are they getting permission from someone to sell it?
